Italian citizenship for foreigners
We help you anticipate or deal with the problems you may encounter when applying for Italian citizenship (by residence, by marriage or iure sanguinis, whose rules were tightened in 2025), giving you all possible support so that not too much time passes after your application.
You can contact us if you need help with:
1. PREPARING THE DOCUMENTS
Applications for Italian citizenship by residence or by marriage are submitted exclusively online through the dedicated portal of the Ministry of the Interior, following the procedure indicated there.
You therefore need to prepare a set of documents to attach to the application so that it can be processed: the list is quite long and changes depending on whether you are applying by residence or by marriage.
2. REMINDER
The Ministry of the Interior must conclude the procedure within 24 months of the application, extendable up to 36. If the deadline has passed without a reply, you can contact us to file a reminder or a formal notice and, if the silence continues, an appeal to the administrative court to obtain a decision.
In this way the lawyer will try to understand the reason for the delay, which sometimes may simply be due to the number of applications reaching the Ministry of the Interior, and to obtain a response on your citizenship application.
3. REFUSAL / DENIAL
If you applied for Italian citizenship but your application was rejected, a partner lawyer can help you file an appeal and understand the reason for the refusal. Pay attention to the court and the deadlines: for citizenship by residence the appeal goes to the TAR Lazio (Regional Administrative Court of Lazio) within 60 days; for citizenship by marriage jurisdiction normally lies with the ordinary courts.
There can be many reasons for a refusal. Among the most common are errors in submitting the documents, missing requirements, gaps in residence, having committed serious offences and so on…
Relying on lawyers who handle immigration law, such as those in the Avvocati per Stranieri network, allows you to face difficult situations more calmly and not miss the deadlines to assert your rights.

Residence permit applications
When it comes to residence permit applications, the scenarios are much the same as for citizenship applications.
You may therefore need to speak to a lawyer who handles this area for:
1. REMINDER
The Questura must issue, renew or convert the residence permit within 90 days of the application (Article 5(9) of the TUI), but in practice times are often longer. If the deadline has passed without any news, it is advisable to contact a lawyer to file a reminder or a formal notice.
With the help of the lawyers in the Avvocati per Stranieri network you can find out what stage your application has reached and, if necessary, take action before the court to obtain a response.
2. APPEAL
In which cases can a partner lawyer help you file an appeal? For example, if your residence permit application was refused or if the renewal of your permit was rejected. An appeal against a refusal by the Questore of Rome must be filed with the TAR Lazio within 60 days of notification; for permits for family reasons, jurisdiction lies instead with the ordinary Tribunal.
The residence permit can also be revoked or annulled if the assessments on which it was issued turn out to be wrong.
3. CONVERSION
If the reason for your presence in Italy changes, you can convert your residence permit into the most appropriate type, following the procedures set by law, so that your situation is framed in the best possible way.
Each type of residence permit also has its own rules and features, so it is important to find out from a lawyer how to proceed.
We can also help if you are at risk of expulsion from Italy. An appeal against an expulsion order must be filed with the Justice of the Peace (Giudice di Pace) within 30 days of notification: contact us immediately to discuss your situation and understand how to act.
Family reunification
The family reunification procedure allows you to bring your family to Italy (provided certain requirements are met). The application is submitted online to the Single Desk for Immigration (Sportello Unico per l’Immigrazione) of the Prefecture and, as in all other cases, precise and accurate documentation must be provided.
The partner lawyers in our network are therefore at your disposal for:
1. HELP WITH THE APPLICATION
Without going into too much detail, the documents to attach to a family reunification application are many and vary according to who is applying and their situation. At this stage it is very easy to make mistakes, and unfortunately even a small error can cause delays or even the rejection of the application, so asking experienced lawyers for concrete help is the best way to submit it correctly.
In addition to the income and accommodation requirements, since December 2024 you must have completed at least two years of uninterrupted legal residence in Italy to bring over your spouse, dependent adult children or parents. This requirement does not apply to minor children or to holders of international protection.
2. REMINDER
In family reunification cases, too, the Prefecture’s response may be slow to arrive, with serious consequences for the family of the foreign citizen waiting to be reunited. The clearance (nulla osta) must be issued within 150 days of the application.
Once this deadline has passed, it is worth contacting a partner lawyer to file a reminder as soon as possible and try to obtain a response quickly.
3. APPEAL
If instead your application was rejected, you need to understand the reasons for the refusal, which are very often due to errors in submitting the application or to the lack of key requirements (such as accommodation or income) needed to obtain reunification.
If documents and requirements are in order, you can file an appeal against the refusal of the clearance, which falls under the jurisdiction of the ordinary Tribunal: to do so, it is best to contact experienced lawyers quickly.

Foreign workers’ rights
Problems at work are always very delicate, and you need to rely on well-prepared lawyers to handle them in the best possible way.
The lawyers in our network have often helped foreign citizens who were in serious difficulty at work, with colleagues or employers, for the following problems:
1. UNFAIR DISMISSAL
If your employer has unfairly dismissed you, a partner lawyer can help you challenge the dismissal before the Labour Court and assert your rights.
Pay attention to the deadlines: the dismissal must be challenged in writing within 60 days of the notice, and the claim must be filed within the following 180 days (Article 6 of Law 604/1966). Once these deadlines expire, the right is lost.
2. DISCRIMINATION AND MOBBING
Unfortunately these are present in the workplace and cause great pain to those who suffer them. A partner lawyer can help you stop this unlawful conduct and claim compensation for the damage suffered.
3. UNPAID WAGES AND PAYSLIPS
If your employer does not pay you regularly or does not give you your payslips, it is time to involve a lawyer experienced in labour law for foreigners who can help you recover what you are owed, including through a petition for an injunction order.
Don’t worry: throughout the process the lawyer will be by your side to protect your rights as well as possible.
