What we deal with

Italian citizenship for foreigners

(Click the + button to read the answer)

The reasons can vary: sometimes a single document submitted incorrectly is enough to block the application.

The remedy depends on the type of application: if you applied for citizenship by residence, the refusal is challenged before the TAR Lazio (Regional Administrative Court of Lazio) within 60 days; if the application was by marriage, jurisdiction normally lies with the ordinary courts, unless the refusal is based on reasons of State security.

Contact Avvocati per Stranieri: a partner lawyer will examine the decision and tell you which court has jurisdiction.
EU citizens benefit from a more favourable rule. Article 9(1)(d) of Law 91/1992 allows them to apply for citizenship by residence after 4 years of legal and uninterrupted residence in Italy, instead of the 10 years required for non-EU citizens.

Please note: residence must be continuous. Deregistration from the registry office (anagrafe) resets the count to zero. An Italian language certificate at B1 level is also still required.

Once the application has been submitted, the procedure must be concluded within 24 months, extendable up to a maximum of 36.
Yes, it is one of the essential documents for applying for and obtaining citizenship. It must also be provided for any third countries where the applicant has lived.

Certificates issued by EU countries are exempt from legalisation; for other countries, consular legalisation is required, or an apostille if the country is a party to the Hague Convention.
You can check the status of your application directly online, through the portal of the Department for Civil Liberties and Immigration, logging in with the same credentials you received when you applied.

Residence permit applications

(Click the + button to read the answer)

If your residence permit has been revoked, we recommend that you immediately contact a partner lawyer specialising in immigration law, who can examine the decision and identify the reason for the revocation. The deadlines to challenge it are short: don’t wait.
The Questore’s refusal can be challenged by an appeal to the TAR (Regional Administrative Court) of the place where the Questura that issued the decision is located, within 60 days of notification. Permits for family reasons are an exception: these fall under the jurisdiction of the ordinary courts.

A partner lawyer can assess the decision and prepare the appeal before the competent court.
The costs are made up of a fixed part and a variable part.

Fixed costs:
• €16 revenue stamp (marca da bollo)
• €30.46 for printing the electronic residence permit
• €30 to the post office operator for sending the insured envelope

Contribution, which varies according to the duration and type of permit:
• €40 for permits lasting more than three months and up to one year
• €50 for permits lasting more than one year and up to two years
• €100 for the EU long-term residence permit

The contribution is added to the €30.46 on the same payment slip. Some categories are exempt, including minors under 18 and asylum seekers.
The documents to be submitted vary depending on the type of residence permit you want to apply for. To avoid mistakes and the resulting delays, we recommend getting assistance from a partner lawyer experienced in this field through “Avvocati per Stranieri“.

Family reunification

(Click the + button to read the answer)

Getting assistance from the start helps you submit the application correctly and reduce waiting times. Get in touch with the partner lawyers in the Avvocati per Stranieri network, experts in immigration law and ready to accompany you throughout the process.
If the application has been refused, it is most likely because the required conditions are not met: the income requirement, the health and hygiene requirement for the accommodation, or complete documentation.

A refusal of the clearance is challenged before the Tribunal, in the section specialised in immigration matters, because in this area jurisdiction lies with the ordinary courts. Contact us and a partner lawyer will assess the decision.
Not all relatives can join you in Italy. Under Article 29 of the TUI, the following can:
• your spouse, not legally separated and aged 18 or over
• minor children
• dependent adult children who cannot support themselves for health reasons
• dependent parents, where the conditions set by law are met
Under Article 29(8) of the TUI (Consolidated Immigration Act), the reunification clearance must be issued by the Prefecture within a maximum of 90 days of the application.
If your application is being delayed, a partner lawyer can file a reminder.

Foreign workers’ rights

(Click the + button to read the answer)

You can challenge the dismissal before the Labour Court, but the deadlines are short and mandatory.

Under Article 6 of Law 604/1966, the dismissal must be challenged in writing within 60 days of receiving the notice. Within the following 180 days you must then file the claim in court or start a conciliation attempt.
If these deadlines expire, the right to challenge is lost for good, even when the dismissal would be unlawful.

Get in touch immediately with a partner lawyer from Avvocati per Stranieri and assert your rights.
Write to us describing your situation: we will put you in touch with a partner lawyer who will assess which route to take and can assist you in submitting your counter-arguments within the deadlines.
Ask for help from a partner lawyer specialising in labour law for foreigners. It is possible to take action to stop the conduct, which is harmful to your physical and mental health, and to obtain compensation for damages.
If you are in this situation, write to us: a partner lawyer will assess your position and the possible actions to obtain compensation for damages.
