What we deal with

Italian citizenship for foreigners

(Click the + button to read the answer)

The refusal decision must state its reasons: the first step is to have it examined to understand what it is based on. Contact Avvocati per Stranieri and we will put you in touch with a partner lawyer, who can also file a request for access to records to reconstruct how the case was assessed.
You can file an appeal, but the competent court depends on the type of application.

If you applied for citizenship by residence, the refusal is challenged before the TAR Lazio (Regional Administrative Court of Lazio) within 60 days. If the application was by marriage, jurisdiction normally lies with the ordinary courts, unless the refusal is based on reasons of State security.

Choosing the wrong court makes the appeal inadmissible: have the decision assessed by a partner lawyer experienced in immigration law before taking action.
By checking the portal of the Department for Civil Liberties and Immigration directly online: by logging in with the credentials provided when you started the application, you can see in real time what stage the procedure has reached.
The legal deadline for concluding the procedure is 24 months, extendable up to a maximum of 36. If your file has been stuck beyond these deadlines, a partner lawyer from our network can check the status of your application and file a formal reminder.

Residence permit applications

Write to us and we will put you in touch with a partner lawyer, who will examine your position: a stuck application, a request for additional documents, a notice of intended rejection or a refusal already served all require different responses and, in some cases, have very short deadlines.
There can be various reasons for the refusal: no longer meeting the income or employment requirements, problems with the accommodation document, or a criminal record.

The Questore’s refusal can be challenged by an appeal to the TAR (Regional Administrative Court) of the place where the Questura that issued the decision is located, within 60 days of notification. Permits for family reasons are an exception: these fall under the jurisdiction of the ordinary courts.

Request a consultation and a partner lawyer will assess the reasons and the route to take.
The law allows it, but only in the cases and in the manner provided: not all permits can be converted, and some conversions fall within the quotas of the flows decree (decreto flussi). To avoid mistakes, we recommend contacting a partner lawyer experienced in immigration law.
There are many reasons: employment or self-employment, business, family reasons, study, medical treatment, religious reasons, asylum and international protection, job seeking and so on.
Each type has different requirements, duration and conversion options: that is why it is advisable to find out which one is right for you before applying.

Family reunification

(Click the + button to read the answer)

The application is submitted online on the Services Portal of the Ministry of the Interior, logging in with SPID. Contact a partner lawyer from our network: they will help you fill in the application correctly and gather all the necessary documents.
You must prove that you have sufficient income and suitable accommodation, with a certificate of health and hygiene suitability issued by the Municipality or the local health authority (ASL). You also need the documents proving the family relationship, translated and legalised or apostilled, and a residence permit valid for at least one year. If you need more information, contact us.
Yes, it is one of the fundamental requirements. Under Article 29(3)(b) of the TUI, you need an income not lower than the annual amount of the social allowance (assegno sociale), increased by half for each family member to be reunited.

For 2026 the social allowance amounts to €546.24 per month for 13 monthly payments, i.e. €7,101.12 per year. The minimum income required is therefore:
• 1 family member: €10,651.68
• 2 family members: €14,202.24
• 3 family members: €17,752.80
• 4 family members: €21,303.36

For the reunification of two or more children under the age of 14, an income of not less than twice the annual social allowance is required in any case. The amounts are revalued every year by INPS.
A refusal of the clearance is challenged before the Tribunal, in the section specialised in immigration matters, because in this area jurisdiction lies with the ordinary courts and not with the administrative courts.

Request a consultation in person or online: a partner lawyer will examine the decision to understand the reasons for the refusal and assess an appeal.

Foreign workers’ rights

(Click the + button to read the answer)

Since 12 March 2016, under Article 26 of Legislative Decree 151/2015, voluntary resignation must be submitted exclusively online, using the Ministry of Labour form: resignations submitted in any other way are ineffective. Exceptions include domestic work and resignations given in protected settings.

You can revoke your resignation within 7 days of sending it, using the same procedure.

Before resigning, however, it is worth assessing your situation: unlike dismissal, voluntary resignation means losing certain protections, and in some circumstances it can affect the renewal of your residence permit. Contact a partner lawyer experienced in labour law before going ahead.
These are two separate issues, both with deadlines to meet. For unpaid wages, a partner lawyer can start a debt recovery procedure, including a petition for an injunction order. For disciplinary charges, on the other hand, it is essential to submit your counter-arguments within the deadlines set by the collective agreement.

Tell us about your problem and we will put you in touch with a partner lawyer.
You can contact us and explain what is happening. A partner lawyer can take action before the Labour Court to stop the unlawful conduct and claim compensation for damages.
You can challenge the dismissal before the Labour Court, but the deadlines are short and mandatory.

Under Article 6 of Law 604/1966, the dismissal must be challenged in writing within 60 days of receiving the notice. Within the following 180 days you must then file the claim in court or start a conciliation attempt.
If these deadlines expire, the right to challenge is lost for good, even when the dismissal would be unlawful.

This is why we recommend contacting a partner lawyer experienced in labour law immediately.
