What we deal with

Italian citizenship for foreigners

(Click the + button to read the answer)

To submit a citizenship application you first need the required documents, and then you must register on the services portal of the Ministry of the Interior, logging in with SPID. If you need help, contact Avvocati per Stranieri and we will put you in touch with a partner lawyer who will assist you in preparing the application.
The maximum duration of the procedure is 24 months, extendable up to 36.

In case of refusal, times get longer, because the decision must be challenged before the competent court: for citizenship by residence the TAR Lazio (Regional Administrative Court of Lazio) within 60 days, for citizenship by marriage normally the ordinary courts. Choosing the wrong court makes the appeal inadmissible.
It depends on your situation, and the answer is often more favourable than people think.

If you obtain citizenship, Article 14 of Law 91/1992 provides that minor children living with you acquire it together with you, without having to wait until they come of age. Following the amendments introduced by Law 74/2025, however, the minor must have been legally resident in Italy for at least two continuous years on the date the parent acquires citizenship, or since birth if under two. As adults they may renounce it, if they hold another citizenship.

If instead neither parent becomes Italian, a child born in Italy who has lived here legally and without interruption can declare that they wish to acquire citizenship within one year of turning 18. Those born abroad who arrived as minors follow the ordinary procedure for citizenship by residence.

This area has changed recently: have a partner lawyer assess your situation before assuming you have to wait.
Citizenship can be applied for by marriage to an Italian citizen, by residence in Italy, or recognised by descent. In every case you must meet the requirements set by law, which vary from one case to another: for EU citizens, for example, the residence required is 4 years instead of 10. Contact a partner lawyer to find out which requirements apply to your case.

Residence permit applications

(Click the + button to read the answer)

You can, in the cases and in the manner provided by law. To avoid mistakes, we recommend that you contact Avvocati per Stranieri and request a legal consultation with a partner lawyer, who will check whether conversion is allowed in your case.
Contact Avvocati per Stranieri: a partner lawyer can file a request for access to records to find out the reasons for the block and assess how to unblock the application.
With a residence permit you can register with the local registry office and consequently obtain an identity card and a tax code, with which you can apply for health care, open a bank account and so on. The permit also allows you to carry out the activities indicated in it.
Under Article 5(9) of the TUI, the residence permit must be issued, renewed or converted within 20 days of the application being submitted.

In practice, actual times are much longer and vary from one Questura to another. However, exceeding the legal deadline is not without consequences: it allows you to send a formal reminder to the office and, in cases of prolonged delay, to use the remedies available against administrative inaction. If you are experiencing delays, you can contact Avvocati per Stranieri.

Family reunification

(Click the + button to read the answer)

You need sufficient income and suitable accommodation, as well as a residence permit valid for at least one year.

As regards income, Article 29(3)(b) of the TUI requires an amount not lower than the annual social allowance (assegno sociale), increased by half for each family member to be reunited. For 2026 the social allowance is €546.24 per month for 13 monthly payments, i.e. €7,101.12 per year: the minimum income is therefore €10,651.68 for one family member and €14,202.24 for two.
If you need help preparing the documents, write to us.
A refusal of the clearance is challenged before the Tribunal, in the section specialised in immigration matters, because in this area jurisdiction lies with the ordinary courts and not with the administrative courts.

Contact a partner lawyer and explain your situation: they will assess the reasons for the refusal and the route to take.
Under Article 29(8) of the Consolidated Immigration Act, the clearance must be issued by the Prefecture within a maximum of 90 days of the application. In case of delay, a partner lawyer can file a reminder.
Under Article 29 of the TUI: your spouse, not legally separated and aged 18 or over; minor children; dependent adult children who cannot support themselves for health reasons; dependent parents, where the conditions set by law are met. If you need help to be reunited with your family, rely on a partner lawyer from our network.

Foreign workers’ rights

(Click the + button to read the answer)

Before resigning, it is advisable to assess the situation with a partner lawyer specialising in labour law: unlike dismissal, voluntary resignation means losing certain protections, and in some circumstances it can also affect the renewal of your residence permit.

Remember also that resignation must be submitted online, following the procedure provided by law: a resignation given only verbally or in writing to the employer has no effect.
You can challenge the dismissal before the Labour Court, but the deadlines are short and mandatory.

Under Article 6 of Law 604/1966, the dismissal must be challenged in writing within 60 days of receiving the notice. Within the following 180 days you must then file the claim in court or start a conciliation attempt.
If these deadlines expire, the right to challenge is lost for good.

Request a legal consultation now with a partner lawyer experienced in labour law for foreigners.
Contact us and tell us about your situation: we will put you in touch with a partner lawyer, who can take action to stop the unlawful conduct and claim compensation for damages.
