What we deal with

Italian citizenship for foreigners

(Click the + button to read the answer)

The legal deadline for concluding the procedure is 24 months, extendable up to a maximum of 36. If your file has been stuck beyond these deadlines, it is likely to be worth filing a reminder: by contacting Avvocati per Stranieri we will put you in touch with a partner lawyer who will check the status of your application.
For applications submitted on or after 20 December 2020, the maximum duration of the procedure for obtaining Italian citizenship is 24 months, extendable up to a maximum of 36.
It means that you have to attach again some documents that the Ministry does not consider properly legalised or scanned. In this case you have a precise deadline, and to avoid mistakes that would further lengthen the citizenship procedure we recommend contacting a partner lawyer from the Avvocati per Stranieri network.
You can file an appeal, but the competent court depends on the type of application.

If you applied for citizenship by residence, the refusal is challenged before the TAR Lazio (Regional Administrative Court of Lazio) within 60 days. If the application was by marriage, jurisdiction normally lies with the ordinary courts, unless the refusal is based on reasons of State security.

Choosing the wrong court makes the appeal inadmissible: it is advisable to have the decision examined by a partner lawyer specialising in immigration law before taking action.

Residence permit applications

(Click the + button to read the answer)

There can be various reasons: no longer meeting the income or employment requirements, problems with the accommodation document, or a criminal record.

The Questore’s refusal can be challenged by an appeal to the TAR (Regional Administrative Court) of the place where the Questura that issued the decision is located, within 60 days of notification. Permits for family reasons are an exception: these fall under the jurisdiction of the ordinary courts.

Write to us and a partner lawyer will examine the decision to identify the competent court and the grounds for appeal.
The costs are made up of a fixed part and a variable part.

Fixed costs:
• €16 revenue stamp (marca da bollo)
• €30.46 for printing the electronic residence permit
• €30 to the post office operator for sending the insured envelope

Contribution, which varies according to the duration and type of permit:
• €40 for permits lasting more than three months and up to one year
• €50 for permits lasting more than one year and up to two years
• €100 for the EU long-term residence permit

Some categories are exempt from the contribution, including minors under 18, asylum seekers and those applying for a permit for medical treatment.
The documents needed to apply for a residence permit vary according to the type of permit, but as a rule you will always need a photocopy of your passport, a photocopy of the accommodation document and a photocopy of the income document. If you need help, request a consultation with a partner lawyer.
To obtain a residence permit you must have entered Italy legally with a valid entry visa and submit the application within 8 working days of entering the country, as provided by Article 5(2) of the TUI.

Since there are many types of permit and the requirements change from one to another, it is advisable to speak to a lawyer to get all the information you need.

Family reunification

(Click the + button to read the answer)

Write to us and we will put you in touch with a partner lawyer who will assist you in submitting your family reunification application and gathering the necessary documents.
In most cases the refusal is due to failure to meet one of the required conditions: the minimum income, the health and hygiene suitability of the accommodation or complete documentation. Contact a specialised partner lawyer to have the decision examined and identify the reason for the refusal.
Yes. In this matter jurisdiction lies with the ordinary courts: a refusal of the clearance is challenged before the Tribunal, in the section specialised in immigration matters, and not before the administrative courts.

A partner lawyer can take care of every aspect of the appeal and assist you until the decision.
Under Article 29(8) of the TUI, the reunification clearance must be issued by the Prefecture within a maximum of 90 days of the application. If your application is taking longer than expected or you have not received any updates, it is best to contact Avvocati per Stranieri to have a reminder filed.

Foreign workers’ rights

Contact a partner lawyer experienced in labour law for foreigners by requesting an online or in-person consultation: they can set up a debt recovery procedure to obtain your unpaid wages.
You can challenge the dismissal before the Labour Court, but the deadlines are short and mandatory.

Under Article 6 of Law 604/1966, the dismissal must be challenged in writing within 60 days of receiving the notice. Within the following 180 days you must then file the claim in court or start a conciliation attempt.
If these deadlines expire, the right to challenge is lost for good, even when the dismissal would be unlawful.

If you have received a dismissal letter, contact a partner lawyer immediately.
Contact us and we will put you in touch with a partner lawyer, who can take action to stop the unlawful conduct and claim compensation for damages.
With the assistance of a partner lawyer it is possible to file a petition for an injunction order and obtain an enforceable title to recover the amount you are owed.
